These Terms of Service (“Terms”) govern your access to and use of the Miguel de Mora Garcia website, wedding photo albums, and related services (the “Service”). By creating an album, paying for the Service, uploading content, or browsing an album, you agree to these Terms.

1. Who we are

Miguel de Mora Garcia provides a shared wedding photo album accessed via a QR code and web link. Guests can upload photos and browse the album without creating an account. Album owners manage their albums through an authenticated dashboard.

2. The Service

After a successful one-time payment, we create a paid album with a public URL and printable QR materials. Guests may upload photos to that album and view photos uploaded by others for as long as the album remains active.

Unless stated otherwise at checkout, storage lasts three (3) months from the wedding date when a wedding date was provided at checkout; otherwise three (3) months from the payment date. After expiry, uploads may be disabled and content may be deleted as described in our Privacy Policy.

3. Eligibility and accounts

You must be at least 18 years old (or the age of majority where you live) to purchase an album. If you create an owner account, you are responsible for keeping your login credentials secure and for activity under your account.

Guests do not need an account. Optional guest names you enter when uploading are visible to others in the album.

4. Payments

Album purchases are processed by Stripe. Prices shown at checkout include applicable taxes where we are required to collect them. Payment is one-time unless we clearly offer another product.

Because digital album access is provisioned immediately after payment, refunds are generally not available once the album has been created, except where required by law or where we determine a technical failure prevented delivery of the Service.

5. Your content

You retain ownership of photos and other content you upload (“User Content”). You grant Miguel de Mora Garcia a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and process User Content solely to operate and improve the Service (including backups, abuse prevention, and delivering the album to authorised viewers).

You represent that you have all rights needed to upload User Content and that it does not infringe others’ rights or violate law. Do not upload illegal, harmful, or non-consensual intimate imagery.

6. Album owners’ responsibilities

If you purchase or control an album, you are responsible for how the QR code and album link are shared, for moderating guest uploads where appropriate, and for informing guests that photos will be visible to anyone with the link.

Album URLs are unguessable but not secret once shared. Treat the link like a shared photo folder.

7. Acceptable use

You may not misuse the Service, including by attempting to disrupt it, scrape it at scale, bypass rate limits, probe security, upload malware, or use it for spam or unlawful surveillance.

We may suspend or remove albums, content, or access that violate these Terms or create risk for other users.

8. Third-party services

The Service relies on providers such as Stripe (payments), Clerk (authentication), Cloudflare R2 (file storage), Resend (email), and, where you consent, Google Analytics. Their terms and privacy practices also apply to the processing they perform.

9. Availability and changes

We aim for reliable availability but do not guarantee uninterrupted Service. Features, pricing, and storage periods may change; material changes will be reflected on the site or communicated where required.

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use after changes constitutes acceptance of the updated Terms where permitted by law.

10. Disclaimers and liability

The Service is provided “as is” and “as available” to the fullest extent permitted by law. We do not warrant that albums will be error-free or that every upload will succeed on every device.

To the fullest extent permitted by law, Miguel de Mora Garcia’s total liability arising out of or relating to the Service is limited to the amount you paid us for the album giving rise to the claim in the twelve (12) months before the claim. We are not liable for indirect, incidental, special, consequential, or lost-data damages, except where liability cannot be limited (including for death or personal injury caused by negligence, or fraud).

11. Governing law

These Terms are governed by the laws of Spain, without regard to conflict-of-law rules, unless mandatory consumer protections in your country of residence require otherwise. Courts in Spain have non-exclusive jurisdiction, subject to those mandatory rights.
